ARTICLE 1 – PARTIES

1.2 – BUYER:
The person who is a registered member of the shopping website semutr.com as a customer. The address and contact information provided during registration are considered valid.

ARTICLE 2 – SUBJECT

The subject of this contract is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product(s), the characteristics and sales price of which are specified below, ordered electronically by the BUYER from the website semutr.com owned by the SELLER.

ARTICLE 4 – GENERAL TERMS

4.1 – The BUYER declares that they have read and been informed of the basic features of the product, its sales price, payment method, and delivery terms on the website of {COMPANY_NAME}, and has confirmed this electronically.

4.2 – The product subject to this contract will be shipped to the BUYER or to the person/institution at the delivery address indicated by the BUYER within the legal period of 7 business days, unless otherwise stated.

4.3 – If the product is to be delivered to someone other than the BUYER, the SELLER cannot be held responsible if the recipient refuses the delivery.

4.4 – The SELLER is responsible for delivering the product complete, undamaged, and in accordance with the characteristics specified in the order.

4.5 – For the delivery of the product, this contract must be signed and received by the SELLER, and the payment must be completed using the BUYER’s selected payment method. If the product price is not paid or the transaction is canceled in bank records for any reason, the SELLER is not obligated to deliver the product.

4.6 – If, after delivery, the BUYER’s credit card is used unlawfully or by unauthorized persons (through no fault of the BUYER), and the related bank or financial institution does not pay the product price to the SELLER, the BUYER must return the delivered product to the SELLER within 3 days. In this case, the shipping cost belongs to the BUYER.

4.7 – If the SELLER cannot deliver the product on time due to force majeure (natural disasters, adverse weather, transportation disruptions, etc.), they must notify the BUYER.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 14 days from the delivery of the product to themselves or the recipient they specified. To use the right of withdrawal, the BUYER must notify the SELLER at semukids.tr@gmail.com within this period, and the product must be unused in accordance with Article 6.

In the event the withdrawal right is used, the product must be returned along with the original invoice and the shipping receipt as proof of return. Once these documents are received, the product price will be refunded to the BUYER within 14 days. If the original invoice is not returned, VAT and other legal obligations cannot be refunded.

The cost of return shipping in case of withdrawal will be covered by the SELLER.

General return/exchange conditions are as follows:

  • According to Law No. 6502 on the Protection of Consumers, products made or personalized upon the BUYER’s request (custom prints, custom sizes) cannot be returned or exchanged.

  • Products that are no longer resalable (washed, worn, sprayed with perfume, tag removed) will not be accepted for return.

  • Return and exchange requests must be made within 14 days of the order date. Beyond this period, returns/exchanges will not be accepted.

  • In return and exchange cases, shipping costs are borne by the BUYER.

ARTICLE 6 – NON-RETURNABLE ITEMS EVEN IF DUE TO SELLER FAULT

The right of withdrawal cannot be used for the following items:

  • Washed products

  • Worn products

  • Products that have absorbed odors

  • Damaged products for any reason

ARTICLE 7 – COMPETENT COURT

In the implementation of this contract, the Consumer Arbitration Committees and Consumer Courts located in the place of residence of the BUYER or SELLER have jurisdiction up to the value announced by the Ministry of Industry and Trade.

By completing the order, the BUYER is deemed to have accepted all the terms of this contract.
